Mr. Andrey Tsyganov: “We should fight against cartels together”

“The antimonopoly service will fight against hard economic violation – cartels - together with law-enforcement agencies and public prosecution bodies”, - said the Deputy Head of the Federal Antimonopoly Service Mr. Andrey Tsyganov on the BRIC International Competition Conference in Kazan (Tatarstan).

Today apart from antimonopoly bodies law-enforcement agencies and public prosecution bodies carry out fighting against cartels.

For  strengthening anticartel work within the state competition policy special  anti-cartel division was established in the structure of the FAS Russia. It works together with structural units which inspect and take control over observance of antimonopoly legislation in separate sectors of economy as well as it provides cooperation between FAS Russia and law-enforcement agencies when making investigation of cartel agreements.

The Deputy Head of the FAS Russia exposed the main methods of obtaining information from the other state bodies and procedure of cooperation with them as well as powers of competition authority in cartels investigation.

Regarding  interaction between the authorities during the cartels investigation Mr. Andrey Tsyganov noted that even in 2004 the FAS Russia and the Ministry of Internal Affairs of the Russian Federation signed a Decree on cooperation.

Among other functions of the FAS Russia  in the frameworks of cooperation between the FAS Russia and the Ministry of Internal Affairs Mr. Andrey Tsyganov marked: informing about all facts of economic, fiscal and other violations revealed  during their activities, providing MIA Russia  with materials on violations with the signs of criminally liable anticompetitive actions.
“Thereby evidence could be collected across by competition and law-enforcement agencies in the frameworks of their powers”, - marked  The Deputy Head of the FAS Russia.

In its turn the Ministry of Internal Affairs informs the antimonopoly service on revealed violations and renders practical assistance in carrying out inspection, collection and assignment of evidence of violations of competition legislation.

“It will be easier for the FAS Russia to fight against anticompetitive actions after adoption of the Decree of the Plenary Session of Arbitration Court of the Russian Federation “On some questions in respect to implementation of the antimonopoly legislation by the Arbitration Courts”. The authority could prove anticompetitive concerted actions with indirect evidence without documental confirmation of the violation”, - underlined Mr. Tsyganov.

Mr. Andrey Tsyganov expressed his confidence that cooperation between authorities, sharing of opinions and dialoging will favour to creation of a system of fair competition principles and methods.
