Arthur Badin (President of CADE)

Arthur Badin was nominated President of the Administrative Council for Economic Defence (CADE) in November 12th, 2008, after being appointed by the President of the Republic and approved by the Federal Senate for a mandate of two years (2009/2010). His administration is committed to three fundamental strategic objectives: (a) to advance the modernization of the Brazilian antitrust legislation and of CADE's structure; (b) to increase the efficiency of the Brazilian competition policy; and (c) to turn CADE into a center of excellence in the federal public administration.

Arthur Badin was Chief Attorney of CADE in the mandates of 2006/2007 and 2008/2009 (the latter interrupted by reason of his appointment as President of CADE). Under his guidance, the Attorney General Office of CADE has obtained a significant increase on the implementation, and therefore the effectiveness, of CADE's Board decisions before Brazilian judicial courts. As a result, incentive for economic agents to adopt anticompetitive behavior has decreased and there has been a development of jurisprudence on competition by the courts.

From 2003 to 2005, Arthur Badin was Chief of Staff at the Economic Law Office of the Ministry of Justice - SDE. During this period, he was in charge of the coordination and implantation of the first search and seizure operation on competition, as well as of the negotiation of the first leniency agreements in Brazil - innovations that have made the repression of cartels much more effective. Additionally, he acted in the elaboration of the national consumer defence policy. In the same period, Arthur Badin chaired the Administrative Board of the Federal Fund for the Defence of Diffused Rights - CFDD, at the Ministry of Justice.
CADE's current President was also a Board Member of the Private Insurance National Council - CNSP (2004/2005) and Executive Secretary of the Brazilian Reinsurance Institute (IRB-Brasil Resseguros S/A.) in 2005. He was also a Member of the Supplemental Health Chamber - CSS at the Supplemental National Health Agency - ANS (2003/2005) and of the National Council for Metrology, Normalization and Industrial Quality - CONMETRO (2004).

Badin also participated in the implementation of the microeconomic reform agenda at the Secretariat for Economic Policy of the Ministry of Finance - SPE (2003/2005), actively collaborating in the preparation of many bills that had the goal of enhancing business environment in the country, such as the Reinsurance Market Openness Law (Complementary Law 126/2007), New Bankruptcy Act (Law 11.101/05), Folio Consignation Act (Law 10.953/04), the Law that enacts about the Affection Equity of real state incorporations, Real State Credit Note, Real State Credit Document, Bank Credit Certificate and Chattel Mortgage as a Collateral (Law 10.931/04), the Law that creates the Medicine Market Regulation Chamber - CMED (Law 10.742/2003), the Law for Reform of the Brazilian Competition System (PLC 5.877/05), the Positive Consume Registry (PLC 5.870/2005), and the renovation of the Civil Prosecution Code (Laws 11.280/2006, 11.187/2005, 11.132/2005, 11.276/2005, 11.277/2006, 11.382/2006).

Prior to working in the public sector, Arthur Badin was partner of a respected Business Law firm located in São Paulo, namely, Lilla, Huck, Malheiros, Otranto, Ribeiro, Camargo e Messina Advogados (1999/2002).
Badin is on a master course at the Economic and Financial Law Department at the USP Law School, the same institution from which he obtained his Law Bachelor degree (1998). He is a specialist in Competition Defence and Regulation from the Getúlio Vargas Foundation Law School in São Paulo - EAESP/FGV (2004) and in Corporate Law from the Pontifícia Universidade Católica in São Paulo - PUC/SP (2001). He was a student at the São Paulo School of Government (1999).

He is a visiting professor in the post-graduation lato sensu courses at the São Paulo and Rio de Janeiro Getúlio Vargas Foundation (FGV) law schools and at the Brasilia Higher Education Institute (IESB).

Badin is Chair of the Editorial Board at the Competition Law Journal and was a member of the Editorial Board at the IRB Journal (2005).
